# Maryland certified payroll: where it goes, when it is due, and what late costs

The rules come from [Maryland's prevailing wage statute](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false), [COMAR 21.11.11.02](https://dsd.maryland.gov/regulations/Pages/21.11.11.02.aspx), and the [Prevailing Wage Unit of the Maryland Department of Labor](https://www.labor.maryland.gov/labor/prev/), read on November 4, 2026.

Last reviewed November 4, 2026 against the sources it cites

The short answer

Maryland public works of [$250,000 or more](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) owned by a State unit or using [25% or more State money](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false) send certified payroll electronically to the Commissioner of Labor and Industry [within 14 days after each payroll period](https://dsd.maryland.gov/regulations/Pages/21.11.11.02.aspx). A late payroll costs [$10 per calendar day](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false); the owner may postpone partial payment estimates. The Unit says [Davis-Bacon jobs do not file with the State](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml), [Baltimore County](https://baltimorecountymd.gov/departments/prevailing-wage/requirements-compliance) and [Montgomery County](https://www.montgomerycountymd.gov/office-procurement/division-business-relations-compliance-dbrc/prevailing-wage-law) name LCPtracker, [Baltimore City](https://codes.baltimorecity.gov/us/md/cities/baltimore/code/5/25-10) differs, so confirm your channel.

- The state law applies to public work contracts of [$250,000 or more](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) when a State unit owns the job with [any State funding](https://www.labor.maryland.gov/labor/prev/prevoverview.shtml) or a local body uses [25% or more State money](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false). Mechanical systems service contracts have their own tests: [section 17-202(e)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) reaches one that is part of a public work contract above the [$2,500 Service Contract Act amount](https://www.govinfo.gov/link/uscode/41/6702). [COMAR 21.11.11.06(A)](https://dsd.maryland.gov/regulations/Pages/21.11.11.06.aspx) separately lists three conditions, among them a value over $2,500 and a bid on or after October 1, 2022.
- [COMAR 21.11.11.02(A)](https://dsd.maryland.gov/regulations/Pages/21.11.11.02.aspx) requires the contractor to submit payroll electronically to the Commissioner of Labor and Industry within 14 days after the end of each payroll period, and .02(C)(1) requires the WH-347 or an equivalent.
- A late payroll costs [$10 for each calendar day](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false) and the public body may postpone partial payment estimates, while a false or fraudulent payroll record carries a [$1,000 civil penalty for each falsified record](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-224&enactments=false).
- The stop-work power in [section 17-221(e)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-221&enactments=false) is triggered by a possible failure to pay the prevailing wage and does not list a late payroll, and a written appeal is due within 72 hours under section 17-221(f)(1).
- The Unit's [FAQ 7](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml) says a project with $2,000 of federal funds plus State money is a Davis-Bacon project and that employers on it do not file certified payroll with the State.
- [Baltimore County](https://baltimorecountymd.gov/departments/prevailing-wage/requirements-compliance) and [Montgomery County](https://www.montgomerycountymd.gov/office-procurement/division-business-relations-compliance-dbrc/prevailing-wage-law) both name LCPtracker as the system for county prevailing wage payroll.

## Where does Maryland certified payroll go?

It depends on who owns the job and whose money pays for it. See also [prevailing wage versus certified payroll](https://wellstanding.com/guides/prevailing-wage-vs-certified-payroll/) and the [state-by-state table](https://wellstanding.com/guides/certified-payroll-requirements-by-state/).

Except for mechanical systems service contracts (below), the state law does not apply to a public work contract under [$250,000](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false). The Unit's [overview](https://www.labor.maryland.gov/labor/prev/prevoverview.shtml) covers State units with any State funding and local owners using State money for 25% or more, though the Unit's [landing page](https://www.labor.maryland.gov/labor/prev/) uses 25% or more for both. [Section 17-201(j)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false) defines those owners and lets a local government opt in by ordinance or resolution with written notice to the Commissioner. It also names the Washington Suburban Sanitary Commission (WSSC) as a public body. A capital project that receives State capital budget funds as a local House of Delegates or Senate initiative is not a "public work" ([section 17-201(k)(2)(ii)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false), [FAQ 6](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml)). [Section 17-202(d)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) reaches certain construction in tax increment financing districts created on or after July 1, 2018 only if a political subdivision, Baltimore City or the Revenue Authority of Prince George's County authorizes it.

| Your job | Where payroll goes |
| --- | --- |
| State owner with any State money, local owner with State money at 25% or more, or WSSC; $250,000 or more | The Unit's electronic system, within 14 days. [COMAR 21.11.11.02](https://dsd.maryland.gov/regulations/Pages/21.11.11.02.aspx)(A) says to submit electronically to the Commissioner of Labor and Industry, and the Unit's [apprenticeship notice](https://www.labor.maryland.gov/labor/prev/prevwagetrainingfundlawnotice.pdf) calls its electronic certified payroll reporting system "required for all State prevailing wage projects." The last row shows a conflicting owner document. |
| Federal money on the job | The Unit's [FAQ 7](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml) treats a project with $2,000 of federal funds plus State money as wholly Davis-Bacon, so its employers do not file with the State. [The statute](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) excludes only the federal part. |
| Baltimore County contract | LCPtracker. The county page states no contract threshold. Where state law applies it governs, and local hire rules can still apply ([county page](https://baltimorecountymd.gov/departments/prevailing-wage/requirements-compliance)). |
| Montgomery County financed, $250,000 or more, no state or federal prevailing wage | The Compliance Monitor, through LCPtracker ([county page](https://www.montgomerycountymd.gov/office-procurement/division-business-relations-compliance-dbrc/prevailing-wage-law)). |
| Baltimore City Board of Estimates contract over $5,000 | Two copies of weekly payrolls within 14 days, to the contracting agency and the Wage Commission. The sections read name no electronic system ([section 25-2](https://codes.baltimorecity.gov/us/md/cities/baltimore/code/5/25-2), [section 25-10](https://codes.baltimorecity.gov/us/md/cities/baltimore/code/5/25-10)). |
| Maryland Stadium Authority contract | One January 2022 [Stadium Authority attachment](https://mdstad.com/sites/default/files/2022-01/Attachment%20H%20-%20Prevailing%20Wage%20Rates%20and%20Determination.pdf) (project MSA 22-038) cites sections 17-201 to 17-226, yet tells the contractor to submit certified payroll to LCPtracker and certify to the Authority. That conflicts with the regulation and the Unit's statement above, and this page cannot reconcile them. Ask the Unit and the Authority in writing which system your contract requires. |

[Section 17-220(b)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false) lists two recipients, the public body and the Commissioner. [COMAR .02(B)](https://dsd.maryland.gov/regulations/Pages/21.11.11.02.aspx) makes the Commissioner responsible for providing the records to the contracting public body, as appropriate, so the regulation describes one submission, to the Commissioner. Check your contract for any added delivery requirement and confirm with the [Prevailing Wage Unit](https://www.labor.maryland.gov/labor/prev/) at 410-767-2342.

Mechanical systems service contracts have their own tests. [Section 17-202(e)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) applies the law to one that is part of a public work contract with a value above the threshold in [41 U.S.C. 6702(a)(2)](https://www.govinfo.gov/link/uscode/41/6702), which is $2,500. [COMAR 21.11.11.06(A)](https://dsd.maryland.gov/regulations/Pages/21.11.11.06.aspx) applies its rule to a service contract that has all three of these:

1. It is valued at more than $2,500.
2. A public body as defined in [section 17-201(j)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false) procured it.
3. It covers a mechanical system installed as part of a building or public work constructed under the Prevailing Wage Law, for a contract bid on or after October 1, 2022.

Section 17-202(e) does not repeat the regulation's second and third conditions. The Unit's [FAQ 3](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml) states only a value, $2,500 or greater. This page cannot say which test applies to a given contract, so ask the Unit in writing, especially at exactly $2,500 or for a contract bid before October 1, 2022.

[Section 17-201(h)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false) defines a mechanical systems service contract as a contract for certain systems. The copy of the statute this page read lists refrigeration, plumbing, electrical and elevator systems as items (2) to (5) and does not show item (1), so check the statute for the full list. Payroll is due only for the weeks worked on the service contract ([COMAR .06(B)](https://dsd.maryland.gov/regulations/Pages/21.11.11.06.aspx)).

## How do you submit payroll to the State?

The Unit's [certified payroll page](https://www.labor.maryland.gov/labor/prev/) points its "Submit a Certified Payroll Report" entry to an electronic [portal](https://www.dllr.state.md.us/PrevWage/).

1. **Register.** Contractors and subcontractors register before entering payroll ([Unit page](https://www.labor.maryland.gov/labor/prev/)). The Unit's step-by-step [deck](https://www.labor.maryland.gov/labor/prev/prev-certified-payroll-submission.pptx) shows no date, but its file properties give a June 2012 creation date and it uses a 2012 sample calendar. Steps 2 and 4 rest on it, so screens may differ.
2. **Enter the determination number.** It has at least five digits (deck).
3. **Pick the work week,** with accurate beginning and ending dates ([Unit instructions](https://www.labor.maryland.gov/forms/prevwageinstcont.pdf), Rev. 5/2023).
4. **Choose Payroll or No Work,** then enter every worker with gross and net pay (deck).
5. **Certify and keep the receipt.** [Section 17-220(c)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false) has each contractor or subcontractor sign the statement for its own records, but the Unit's instructions have the prime certify its subs' on-site payrolls. Ask the Unit which signature the portal records; the deck's text mentions no signature step, and six of its slides are screenshots without text. You can email the receipt to the prime (deck). You cannot delete an entry: choose "Amend" instead of "Certified" ([FAQ 61](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml)).

## When is Maryland certified payroll due, and on what form?

Within 14 days after the end of each payroll period ([COMAR 21.11.11.02](https://dsd.maryland.gov/regulations/Pages/21.11.11.02.aspx)(A)), on the WH-347 or an equivalent (.02(C)(1)). The payroll must carry either the section 17-220 certificate or the WH-347 compliance certificate, "fully completed and executed," and be "numbered serially starting with payroll number one" (.02(C)(2) and (3)). See our [WH-347 guide](https://wellstanding.com/guides/wh-347/). The [instructions](https://www.labor.maryland.gov/forms/prevwageinstcont.pdf) say 14 calendar days, received in that time. With biweekly pay, the regulation counts from the period's end but the deck says to enter weekly, and the sources do not say which controls, so count from the end of each work week you enter.

## Who submits a subcontractor's payroll?

[Section 17-220(b)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false) has each contractor submit its own records and, for work at the site, its subcontractors'. Who signs is where the sources conflict. Section 17-220(c) has the statement signed by the contractor or, for the subcontractor's records, by the subcontractor. The Unit's [instructions](https://www.labor.maryland.gov/forms/prevwageinstcont.pdf) (Rev. 5/2023) say the contractor is responsible for certifying and submitting its subs' on-site payrolls.

If you are a sub, do not assume the prime's certification replaces your own statement. Ask the Unit in writing which signature the portal records.

## What does late payroll cost, and what does it not?

| Failure | Consequence | Source |
| --- | --- | --- |
| Payroll submitted late | $10 for each calendar day late, owed to the public body, which may also postpone partial payment estimates. | [17-220(d)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false) |
| False or fraudulent payroll record | $1,000 for each falsified record, for a material false statement or omission the person knew was false or made with deliberate ignorance or reckless disregard for its truth. Recoverable in a civil action; paid to the State General Fund. | [17-224(g)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-224&enactments=false) |
| Employee paid less than the prevailing wage | $20 per employee per day in liquidated damages plus restitution, or $250 where the contractor knew or should have known and deliberately failed to pay. When the Commissioner finds after investigation that the law may have been violated, the public body withholds enough for the wages and damages pending a final determination. | [17-222(a), (b)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-222&enactments=false), [17-221(d)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-221&enactments=false) |
| Knowingly failing to produce records or attend a hearing in an investigation | A civil fine of up to $1,000, on top of other penalties. Each day is a separate offense. | [17-221(k)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-221&enactments=false) |
| Stop-work order | The Commissioner may stop work at every site where a violation occurred. Appeal in writing within 72 hours or the order is final. Violating it can cost up to $5,000 a day. | [17-221(e), (f)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-221&enactments=false) |
| Persistent and willful violations | After an investigation and an order under section 17-221, your name goes on a list filed with the Secretary of State, and you cannot enter a public work contract for 2 years. | [17-226](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-226&enactments=false) |

The statute's stop-work trigger is a possible failure to pay the prevailing wage, and it does not list a late payroll ([section 17-221(e)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-221&enactments=false)). Section 17-220(d)(2) names only "the contractor" as liable for the $10 a day, and that is the party that submits the subcontractors' records under 17-220(b)(1). A sub should agree with the prime in writing on who submits and by when.

## What is the apprenticeship contribution on the payroll?

The Unit says covered contractors and subcontractors contribute $0.25 per hour for each employee in each covered craft, even with no apprentices ([FAQ 55](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml), [Unit notice](https://www.labor.maryland.gov/labor/prev/prevwagetrainingfundlawnotice.pdf)). It does not have to go to the State. The notice gives three options: participate in a registered apprenticeship training program, contribute to an organization that has one, or pay the State Apprenticeship Training Fund. The statute lets the Secretary set Fund payments at no more than 25 cents an hour ([section 17-605(a)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-605&enactments=false)). Report the payments on the payroll record (section 17-605(c), [FAQ 56](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml)).

The sources disagree on coverage. The statute's covered project is one valued at [$500,000 or more](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-601&enactments=false). The Unit's FAQ 55 says contractors and subcontractors doing work of $100,000 or more on a project covered by the prevailing wage law must contribute, with no $500,000 project line. The Unit's [notice](https://www.labor.maryland.gov/labor/prev/prevwagetrainingfundlawnotice.pdf) puts the $100,000 line on certain subcontractors only.

Section [17-604(a)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-604&enactments=false) uses that same covered-project term. It requires a subcontractor that performs work above the small procurement amount "for a covered project" to give the unit written verification of its contribution plan. That amount is [$100,000 or less for a unit, and $200,000 or less](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=13-109&enactments=false) for General Services and Transportation construction and Natural Resources capital projects. Because 17-604(a) ties the verification to a covered project, one reading is that those amounts are subcontractor lines inside a $500,000 covered project. FAQ 55 draws no such limit, and nothing this page read says which controls. Treat FAQ 55 as the Unit's stated position, and near any of these lines ask the Unit in writing.

A Stadium Authority job adds a second conflict. The January 2022 [Stadium Authority attachment](https://mdstad.com/sites/default/files/2022-01/Attachment%20H%20-%20Prevailing%20Wage%20Rates%20and%20Determination.pdf) says the Authority does not require contribution to the Maryland Apprenticeship and Training Council for its construction contracts. The Unit's FAQ 55 and notice say contractors on State public work projects must contribute, naming a registered program or the State Fund as payee, not the Council, so the attachment may not speak to the same obligation. This page cannot resolve that. If your contract is with the Authority, ask the Unit and the Authority in writing whether the contribution applies to you.

Unpaid contributions are doubled ([section 17-606(a)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-606&enactments=false)). Section 17-606(b) is a separate penalty for willful false statements, up to $1,000 per employee and falsified record.

## Questions

**Does Maryland require certified payroll on every public job?**

No. Except for mechanical systems service contracts, the state law does not apply under $250,000 ([section 17-202(b)(1)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false)), and it generally reaches a job when a State unit owns it, a local owner uses 25% or more State money, or a local government opts in ([section 17-201(j)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-201&enactments=false)). A mechanical systems service contract is covered at a lower line, about $2,500, under [section 17-202(e)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false) and [COMAR 21.11.11.06(A)](https://dsd.maryland.gov/regulations/Pages/21.11.11.06.aspx), and the two tests differ, so ask the Unit which one your contract meets.

**Do I submit to the State if the job also has federal money?**

The Unit's [FAQ 7](https://www.labor.maryland.gov/labor/prev/prevwagefaqs.shtml) says a project with $2,000 of federal funds plus State money is a Davis-Bacon project, and employers on it do not file certified payroll with the State. The statute excludes only the part of the contract paid with federal money where the federal rate applies ([section 17-202(b)(2)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-202&enactments=false)). Ask the Unit and the owner in writing.

**How much is the Maryland late payroll penalty?**

$10 for each calendar day the records are late ([section 17-220(d)](https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf&section=17-220&enactments=false)). [Baltimore County](https://baltimorecountymd.gov/departments/prevailing-wage/requirements-compliance), [Montgomery County](https://www.montgomerycountymd.gov/office-procurement/division-business-relations-compliance-dbrc/prevailing-wage-law) and [Baltimore City](https://codes.baltimorecity.gov/us/md/cities/baltimore/code/5/25-11) each set $10 a day for their own jobs.

**Do I owe the $0.25 apprenticeship contribution with no apprentices?**

The Unit says yes for covered work, whether the money goes to a registered program or the State Fund ([Unit notice](https://www.labor.maryland.gov/labor/prev/prevwagetrainingfundlawnotice.pdf)). Whether your job is covered is where the sources conflict: $500,000 for the project in the statute, $100,000 of work in the Unit's FAQ 55. A January 2022 Stadium Authority attachment also says the Authority does not require contribution "to the Maryland Apprenticeship and Training Council." Ask the Unit and the owner in writing.
