Alaska certified payroll: who files what, and why final payment is held

This page covers AS 36.05, part of the Title 36 laws the labor department's FAQ calls the Little Davis-Bacon Act, the department's Form 07-6058 and prime contractor checklist, and the DOT&PF AASHTOWare contractor page.

Last reviewed against the sources it cites

The short answer

On an Alaska public construction contract over $25,000, every contractor, subcontractor and owner-operator sends its own certified payroll, with Form 07-6058, to the state labor department before the Friday of every second week. The department may not approve the prime's Notice of Completion while any payroll is missing, which holds final payment. Projects the state transportation department administers also require payroll in AASHTOWare Project, where labor department staff review payrolls.

  • AS 36.05.040 requires every contractor and subcontractor on a state or political subdivision construction contract to file a sworn payroll affidavit before the Friday of every second week.
  • The prime contractor checklist says DOLWD may not approve a Notice of Completion if any contractor's, subcontractor's or owner-operator's certified payroll is missing or non-compliant.
  • The prime pays the filing fee, which AS 36.05.045(a) sets at 1 percent of each contractor's contract price, with a $5,000 cap on the total.
  • A subcontractor's payroll sent to the prime does not meet the state filing, because the Title 36 FAQ says every subcontractor and contractor must file with the department.
  • DOT&PF's contractor page says all contractors, owner-operators included, submit certified payroll through AASHTOWare Project on DOT&PF-administered projects.
  • AS 36.05.090(b) bars a debarred person from public construction contracts until three years after the list is published.

Why your final payment is held

Final payment waits on the Department of Labor and Workforce Development (DOLWD). Under AS 36.05.045(c), the agency may release it to the extent DOLWD verifies the first three conditions below and must withhold DOLWD's estimate of wages owed by contractors under investigation, plus unpaid fees.

Condition for releaseWhere it comes from
The prime met the Notice of Work and Notice of Completion rules, fees includedAS 36.05.045(c)(1)(A)
DOLWD "is not conducting an investigation under this title"(c)(1)(B)
DOLWD has issued no notice of violation to any contractor on the contract(c)(1)(C)
DOLWD may not approve the Notice of Completion if any contractor's payroll is missing or non-compliantChecklist, not the statute

The prime answers for a sub's wages DOLWD cannot collect (FAQ Q39). The checklist and FAQ are undated; the FAQ cites items from 2019 and January 2020.

Which filing goes to which owner

AS 36.05.005 limits the chapter to public construction contracts over $25,000. DOLWD's January 2020 letter covers contracts for the State, a political subdivision or a regional school board, and the FAQ excludes federal projects not let for either (see our WH-347 page). FAQ Q37 treats unpaid prevailing rates on projects that private nonprofits award with state grant money as violations on covered projects. For whether the filings attach to such a contract, FAQ Q3 says to ask DOLWD at statewide.wagehour@alaska.gov or (907) 269-4900.

The DOLWD payroll and Form 07-6058

Form 07-6058 is DOLWD's Statement of Compliance, and the form (Rev. Apr. 2025) requires an authorized signer's original signature. The checklist requires the full Social Security number and other worker details even where federal requirements or the agency ask for different information.

Item (2) and the resident hire law

Item (2) of the form still has the signer swear to full compliance with AS 36.10, the 90 percent Alaska resident employment preference. DOLWD says that after an October 2019 Attorney General opinion it no longer investigates or enforces the Alaska Resident Hire Law (FAQ Q36). Ask DOLWD how to complete item (2) before you sign.

The state form or your own?

The form lets you use your own payroll form if it carries everything Form 07-6058 asks for, but says its Statement of Compliance must be used. The checklist says of that statement, "No other form will be accepted." 8 AAC 30.020(c) only requires that your own form carry the same information and statement of compliance. Use Form 07-6058's statement, since the checklist accepts no other.

Which regional office?

8 AAC 30.020(b) assigns the office by judicial district: Juneau for the 1st, Anchorage for the 3rd, Fairbanks for the 2nd and 4th. Form 07-6058 uses latitude: Fairbanks north of N63, Anchorage south of N63, Juneau for Southeast Alaska from Yakutat south. They do not match, so call (907) 269-4900 or email statewide.wagehour@alaska.gov before you mail a payroll.

Every second Friday, or weekly?

Every second Friday is the state floor. AS 36.05.040, 8 AAC 30.020(a), the checklist and FAQ Q16 each set the DOLWD filing at the Friday of every second week, and Form 07-6058 says "at minimum." The statute says before the Friday and the checklist says no later than the Friday, so send it by Thursday. No source says which Friday starts the count.

AS 36.05.070(c)(1) requires pay at least once a week, which governs when you pay. A federal-aid job also carries a weekly federal submission: DOT&PF's Form 25D-55H (text revised June 25, 2026) requires weekly certified payrolls to the contracting agency, but only on a contract that includes it. A July 27, 2026 directive puts it in FHWA-funded projects awarded after June 10, 2026, by addendum or change order if bidding is under way. Where federal and state laws both cover a project, FAQ Q2 says to follow the stricter provisions of both (see our FHWA-1273 page).

The prime's chain: Notice of Award to Notice of Completion

  1. The agency files the Notice of Award, immediately under AS 36.05.035 but within 20 days under 8 AAC 30.010(a) and DOLWD's letter. Pamphlet 400 says the statutes carry the greater weight. The prime passes DOLWD's project number to every sub (FAQ Q10).
  2. Before work starts, the prime files the Notice of Work, listing each contractor's price, and pays the fee of 1 percent of each price, $5,000 at most in total (AS 36.05.045(a)). Emergency work has 14 days after it begins (AS 36.05.045(d)). If the prime works without the notice and fee, DOLWD may issue a cease and desist order and may direct the agency to withhold funds (FAQ Q7).
  3. At completion the prime files the Notice of Completion with any added fee (AS 36.05.045(b)) and enters the final contract amount, which can raise or lower the fee (FAQ Q9).
  4. Once issues are resolved, DOLWD authorizes the agency to release all remaining funds, and the prime takes the approved notice to the agency (FAQ Q8).

DOT&PF projects and AASHTOWare

DOT&PF's contractor page says all contractors, owner-operators included, submit certified payroll through AASHTOWare Project (AWP) on DOT&PF-administered projects. The page is undated. It says a MyAlaska account acts as your signature on a payroll and that contractors must switch to MyAlaska logins by January 2026, a date that has passed.

Does AWP replace the DOLWD filing?

DOT&PF's About page says DOT&PF and DOLWD have reviewed payrolls in AWP since 2021. The Training and Guides page has a Department of Labor section, and its 2025 quick reference guides show a DOLWD analyst resolving employee mismatches and entering the Notice of Completion date on the contract. DOLWD's checklist and FAQ never mention AWP, and no page says AWP replaces the original-signature Form 07-6058. Ask DOLWD (wagehourcertpay@alaska.gov) and DOT&PF (dot.aashtoware@alaska.gov) in writing.

What a late or wrong payroll costs

A contractor who violates the chapter commits a misdemeanor: a fine of $100 to $1,000, 10 to 90 days in jail, or both, each day a separate offense (AS 36.05.060). Failing to report wage payments accurately and on time under AS 36.05.040 counts as disregarding obligations to employees (8 AAC 30.900(6)(E)). Under 8 AAC 30.200 DOLWD considers debarment for willful, aggravated or repeated violations, and may consider a prime for its subs' violations.

A debarred person, and any firm, corporation, partnership or association in which that person has an interest, may not work as a contractor or subcontractor on a state or local public construction contract until three years after the list is published (AS 36.05.090(b)). "Interest" means over five percent of a partnership or association, over ten percent of a corporation's stock, or any office in the business (8 AAC 30.900(10)).

Form 07-6058 warns that willful falsification may bring civil or criminal prosecution, citing Section 1001 of Title 18 and AS 36.05.060. See other states in our state table.

Questions

Does sending my payroll to the prime satisfy the filing?
No. The Title 36 FAQ says every subcontractor and contractor must file with the department.
Can I use my own payroll form or a WH-347?
Your own payroll grid is allowed if it carries everything Form 07-6058 asks for, but the checklist says no other form will be accepted for the Statement of Compliance, so use Form 07-6058's. On a contract that includes Form 25D-55H (text revised June 25, 2026), a WH-347's reverse-side certification meets the federal statement, which the checklist says differs from Form 07-6058's.
How long does DOLWD have to tell the agency what to withhold?
Within 30 days after receiving the Notice of Completion, DOLWD must tell the agency what amount, if any, to withhold (AS 36.05.045(b)). That is not a release date.
Who sees my payroll in AASHTOWare?
DOT&PF and DOLWD staff see only the information relevant to their position, and prime contractors can review subcontractor payrolls (contractor page).
