NJDOT form CR-347: what it is and which payroll form goes where
This page reads NJDOT's announcement BDC24S-20 (January 28, 2025), the 2019 Standard Specifications (a PDF with 2026-10-30 in its file name), the Wage Rate FAQ, the Standard Input (revision log through October 30, 2026), and the CR-347 form itself.

The short answer
CR-347 is NJDOT's own payroll form, not the WH-347, with a Statement of Compliance on page 2. On a federal-aid contract, send the weekly payroll with the CR-347 certification, or identical wording, to the Resident Engineer within 7 days of payment; the contract also calls for MW-562 reports on the NJ Wage Hub, which the Prevailing Wage Act wants within 10 days. On a wholly state-funded contract, use MW-562 within 10 days and upload it to the Wage Hub.
- Attachment 7 B of NJDOT's bulletin BDC24S-20 (January 28, 2025) says federal-aid contractors and subcontractors use the certification on the Department's CR-347 or any form with identical wording, while Attachment 8 of the Standard Input says a properly executed WH-347 certification satisfies the Statement of Compliance requirement.
- Weekly payrolls are due to the Resident Engineer within 7 days of the date of payment on federal-aid contracts and within 10 days on wholly state-funded ones, per Attachments 7 A and 5 A of the same bulletin.
- On a wholly state-funded NJDOT contract, Attachment 5 calls for NJDOL form MW-562 to the Resident Engineer and an upload to the Wage Hub, and on federal-aid contracts Attachment 7 E and paragraph 105.02.05 of the bulletin also call for MW-562 reports and Equal Pay Act information on the Wage Hub.
- Page 1 of the CR-347 has no column for the ethnicity and gender that Attachment 7 A(2) requires, and Attachment 7 E of the bulletin sends gender and race to NJDOL through the MW-562 on the Wage Hub.
- The contract's payroll attachments in the bulletin name delayed or withheld payment, default and termination but no fine, while N.J.S.A. 34:11-56.35(b) allows administrative penalties of up to $2,500 for a first violation of the Prevailing Wage Act and up to $5,000 for each later one.
- N.J.S.A. 34:11-56.29(b)(2) requires certified payroll records to go to NJDOL through its website within 10 days of the date wages were paid, while Attachment 7 A of the bulletin sets 7 days for the RE copy.
Which form goes where on an NJDOT job
NJDOT road and bridge contracts have two payroll tracks. Subpart 105.02.05 separates contracts containing federal funding from wholly state funded ones, and the bulletin gives each its own payroll attachment. Subsection 108.01, paragraph 3, requires the prime to physically incorporate the payroll attachment (Attachment 7 or State Funded Attachment 5) into your subcontract.
| Federal-aid contract (Attachment 7) | Wholly state-funded contract (Attachment 5) | |
|---|---|---|
| Certification | The CR-347 certification, or identical wording, with a signed Statement of Compliance | NJDOL form MW-562, with a signed Statement of Compliance |
| Send to | The Resident Engineer (RE) | The RE, and upload the weekly payroll to the NJ Wage Hub |
| Due | RE copy within 7 days of payment (Attachment 7 A); Wage Hub copy within 10 days, per 34:11-56.29(b)(2) | Within 10 days of the date of payment covered |
| Wage Hub | MW-562 reports (7 E) and Equal Pay Act information (105.02.05) | Weekly payroll upload (105.02.05); 5 E says MW-562 online |
| Records | Three years after all work on the Contract is completed | Attachment 5 states no period; the Act says two years from payment |
The bulletin applies to projects scheduled for Final Design Submission at least one month after January 28, 2025, so an earlier contract may differ. Subsection 105.04 says the Special Provisions govern over the Standard Specifications, so read your own contract. See our Wage Hub guide and MW-562 guide.
What CR-347 is
The Wage Rate FAQ calls CR-347 the certified payroll for federally funded work. The PDF is marked CR-347 (10/2025). Page 1 is the payroll grid, columns 1A to 9, and page 2 the Statement of Compliance.
Ethnicity and gender
Attachment 7 A(2) requires each employee's ethnicity and gender on the payroll, and the CR-347 grid has no column for them. Attachment 7 E sends gender and race to NJDOL through the Wage Hub MW-562, which has Sex, Race and Ethnicity columns (MW-562 form).
Social Security numbers and addresses on a federal-aid job
The FAQ says personal information goes "in its entirety on the first report." The weekly-transmittal clauses differ. Attachment 7 A(1) asks for an identifying number such as the last four Social Security digits, and Attachment 8 of the Standard Input (Section III, paragraph 3.b.(2)) says full Social Security numbers and last known addresses "must not be included on weekly transmittals." Attachment 7 C reconciles them: keep the full records, which agencies may request, and contractors "are required to provide such information upon request." On a wholly state-funded job, Attachment 5 A(1) asks for each employee's address on the payroll, and the MW-562 has an Employee Name and Address column.
CR-347 is not the WH-347
The WH-347 is a US Department of Labor form, published under OMB control number 1235-0008. CR-347 is a different form, issued by NJDOT, but the PDF shows what it shares with the WH-347: columns numbered 1A to 9, as on the current WH-347 in our WH-347 guide, and a page 1 footnote that begins "While use of Form WH-347 itself is optional" and names page 2 of the WH-347, or a document with identical wording, as an example of a Statement of Compliance. Its page 1 header has three check boxes: "Submission of Final DBRA Certified Payroll Form," Prime Contractor and Subcontractor.
Attachment 7 B says to use the certification on the Department's CR-347, "or any form with identical wording." Attachment 8 of the Standard Input, which carries the FHWA-1273 clauses, says in Section III, paragraph 3.b.(2), that the weekly payroll information "may be submitted using Optional Form WH-347 or in any other format desired," and in 3.b.(4) that a properly executed certification on the reverse of the WH-347 "will satisfy the requirement for submission of the 'Statement of Compliance.'"
The CR-347 certification satisfies Attachment 7 B. To use the WH-347 certification in place of CR-347 page 2, get the RE's written OK. See our FHWA-1273 guide.
What the CR-347 certification says
On page 2 the certifying official states that they paid or supervised the payment of the workers and makes the boxed statements, under a warning that willful falsification can bring prosecution and debarment. Per Attachment 7 B, the contractor or subcontractor, or an authorized officer or employee who supervises the payment of wages, executes it. The signature is the contractor's.
Where it goes and who reads it
Attachment 7 A says each Contractor and subcontractor furnishes the RE with weekly payroll reports "within 7 days of the date of payment covered thereby." Attachment 8 (Section III, paragraph 3.b.(1)) says the prime contractor is responsible for submitting all subcontractors' certified payrolls, so ask your prime whether it transmits your payroll or you send it to the RE. The bulletin says certified payrolls "are to be submitted online" but names no delivery method for the RE copy; ask the RE.
The Wage Hub on a federal-aid job
On federal-aid jobs, paragraph 105.02.05 of the bulletin says to file Diane B. Allen Equal Pay Act information to the Wage Hub, and Attachment 7 E says to file completed MW-562 reports there, tying them to the "certified payroll records required pursuant to P.L.1963, c.150," the Prevailing Wage Act. The 7 days in Attachment 7 A is the clock for the RE copy. For the Wage Hub copy, N.J.S.A. 34:11-56.29(b)(2) gives 10 days: records go to the public body and to NJDOL through its website "each payroll period within 10 days of the date on which the wages were paid." NJDOL's Equal Pay Act page says submitting certified payroll on the Wage Hub complies with the Act's public works requirement. For jobs under both laws, see New Jersey versus federal certified payroll.
If it is late, missing or on the wrong form
Attachment 7 D and Attachment 5 D say failure to meet the payroll requirements may result in payment being delayed or withheld under Section 105, default under Section 108, or termination under Section 108. On federal-aid contracts, paragraph 105.02.05 adds disqualification from future bidding as non-responsible. They name no fine; the Prevailing Wage Act has penalties, below.
- Section 105. Subsection 105.01.01 lets the RE suspend Estimates, the Contractor's progress payments (101.03), for failure to carry out provisions of the Contract.
- Section 108. Subsection 108.14 has the Department give the Contractor and the Surety written notice of the cause for default. Attachment 7 D names "default as specified in Section 108," and 108.14 does not name late payroll. Listed causes include failing to follow the direction of the RE (item 5), failing to comply with Contract requirements regarding minimum wage payments, the DBE and SBE programs, and equal employment opportunity (item 13), and, for any other cause whatsoever, failing to carry out the Work in an acceptable manner (item 15). If they do not proceed as the notice specifies within 10 days, the Department may declare default, and 108.15.02 allows termination for cause.
- Prevailing Wage Act. These penalties belong to the Act, not the contract, and the Act can reach a federal-aid job: Attachment 7 E cites P.L.1963, c.150, and the Wage Rate FAQ says highway and airport projects can fall under both the Act and the Davis-Bacon Acts. Section 34:11-56.35(a) makes failing to keep records, or otherwise violating the Act, a disorderly persons offense, with a fine of $100 to $1,000, 10 to 90 days in jail, or both. Section 34:11-56.35(b) also lets the Commissioner assess administrative penalties of up to $2,500 for a first violation and up to $5,000 for each later one. See late certified payroll.
