Which WH-347 version to use now, after the September 30, 2026 date in ALDOT's notice

This page uses 29 CFR 5.5 (eCFR, current as of November 3, 2026), 29 CFR 3.3, and the agency documents linked below, all read on November 4 and 5, 2026.

The short answer

On Davis-Bacon covered work, the current WH-347 is the January 2025 revision (OMB 1235-0008, expires 01/31/2028); state-only prevailing wage jobs follow state rules, not this form. ALDOT's notice says the Wage and Hour Division allowed both versions through September 30, 2026, with the revised form required from October 1, 2026. The form is optional if a substitute carries every element and a signed Statement of Compliance. Check the revision line on agency copies.

  • ALDOT's Notice to Contractors says the Wage and Hour Division set a transition in which both versions are acceptable until September 30, 2026, and that from October 1, 2026 all prime contractors and subcontractors are required to submit certified payroll using the revised WH-347, while an alternative format is allowed if it fully captures every reporting element.
  • A Connecticut DOH copy of the old layout, marked Revised December 2008, prints OMB No. 1235-0008, Expires 09/30/2026, the same date ALDOT gives for the end of the transition; the printed expiry is not a statement of what DOL requires.
  • One slide in an IEDA and IFA CDBG training deck says the new WH-347 must be used starting 1/1/2026, a date that differs from the one ALDOT gives.
  • 29 CFR 5.5(a)(3)(ii)(B) and (C) say the weekly payroll information may be submitted on Optional Form WH-347 or in any other format, but each payroll must come with a signed Statement of Compliance.
  • A West Virginia DOT copy of the current form is marked Rev. January 2025, OMB No. 1235-0008, Expires 01/31/2028.
  • Georgia's DCA-hosted copy is marked Rev. Dec. 2008 and expired 07/31/2024, and DC's DGS-hosted instructions expired 01/31/2015.

The current version is the January 2025 revision

A West Virginia DOT copy of the current form is marked "Rev. January 2025," OMB No. 1235-0008, "Expires: 01/31/2028." DOL's WH-347 instructions page shows the same OMB number and expiry and prints no revision date. ALDOT's notice says the Wage and Hour Division released the revision on January 6, 2025, as a non-fillable PDF and an online fillable form.

Scope. The WH-347 is the report for work covered by the Davis-Bacon Act and Related Acts (29 CFR 5.5(a)(3)(ii)(A)). A state-only prevailing wage job follows that state's own payroll rules, not this page; the state requirements table shows where each state's payroll goes. The September 30, 2026 date below comes from one state DOT's notice, so confirm it with the agency on your contract.

One gap matters here. ALDOT's notice lists a DOL news release at dol.gov/newsroom/releases/whd/whd20251216-0 after its text. dol.gov refused the fetch, so the cutover date on this page rests on ALDOT's account, not on a DOL document read for this page.

Is the form itself required?

No. The signed certification is. 29 CFR 5.5(a)(3)(ii)(B) says the weekly information may be submitted on Optional Form WH-347 or in any other format. Each payroll must come with a Statement of Compliance signed by the contractor or subcontractor, or its agent who pays or supervises payment of the workers (paragraph (C)). Paragraph (D) says the certification on the reverse of the WH-347 satisfies this.

29 CFR 3.3(b) says the statement must be on the back of the WH-347 or on any form with identical wording, so a format you build needs that same wording.

ALDOT's notice allows an alternative format even as it requires the revised WH-347 from October 1, 2026: while the form itself is not mandatory, any alternative must fully capture all reporting elements of the revised WH-347.

The transition date, and what agencies say

ALDOT's notice attributes one cutover date to the Wage and Hour Division: September 30, 2026. The notice says both versions remain acceptable until then and that the revised WH-347 is required from October 1, 2026. The same date is the printed OMB expiry, "Expires 09/30/2026," on the Connecticut copy of the old layout. That is an expiry stamp, not a statement of what DOL requires.

ALDOT, Notice to Contractors for the August 28, 2026 letting (Davis-Bacon page stamped 3/27/2026)Both versions acceptable until September 30, 2026, a period the notice attributes to the Wage and Hour Division. From October 1, 2026, primes and subcontractors are required to submit certified payroll reports using the revised form. The form itself is not mandatory, but any alternative format must fully capture all reporting elements of the revised WH-347.
Iowa IEDA and IFA, federal labor standards training deck (undated; PDF created July 24, 2025)One slide says the new WH-347 must be used starting 1/1/2026. It is a grant-administrator training deck, not an Iowa DOT rule; see the Iowa guide for DOT Form 830176.Not stated on the slide.
Ohio DOT, prevailing wage forms pageLists the WH-347 as published by DOL and links to DOL. It states no cutover date. Also lists an ODOT-published CRL Payroll Spreadsheet and Instructions; see the Ohio guide.
DC DOEE, Clean Water Construction contractor page (undated)Points to DOL's web-based fillable form and printable PDF. It states no cutover date.Contractors may choose an alternative template that meets DOL requirements.
FDOT, Construction Project Administration Manual 5.4.7 (revised March 13, 2018)Predates the 2025 revision and names no revision.WH-347, FDOT Form 700-010-69, or an equivalent document with all the information USDOL requires.

Two dates appear. ALDOT's notice ends the transition September 30, 2026; the Iowa slide says 1/1/2026 and cites no source, and the sources read here do not reconcile them. Both have passed as of November 5, 2026. Ask the agency that holds your contract, in writing, which revision and format it wants. ALDOT's notice does not say whether payroll for weeks before October 1 that you submit later must use the revised form, so ask that too.

How to spot an outdated copy on an agency site

Agency sites post the form in several places. Four of these five copies are out of date; West Virginia's is current, shown for comparison.

Host and documentRevision on the copyOMB number and expiry on the copy
West Virginia DOT, WH-347 formRev. January 20251235-0008, expires 01/31/2028

Connecticut DOH, Attachment 9-10Revised December 20081235-0008, expired 09/30/2026
DC DGS, instruction sheet (not the form)None printed1235-0008, expired 01/31/2015
FDOT, instruction sheet (3/23/2010 footer)None printed1215-0149, expired 12/31/2011

What to check, in order:

  1. The revision line and OMB expiry, top right. The current form says Rev. January 2025 and Expires: 01/31/2028.
  2. The layout. The 2008 form has a withholding exemptions column and, on page 2, paragraph 4 with boxes (a), (b), and (c) and an exceptions table. The current copy has neither and numbers the worker columns 1A to 9.
  3. Not the OMB number alone. The Georgia and Connecticut 2008-layout copies and the DC sheet print 1235-0008, the same number as the current form. Only the 2010 FDOT sheet prints a different one, 1215-0149.

How to check your copy before you send it

  1. Get the form from the Wage and Hour Division website, which 29 CFR 5.5(a)(3)(ii)(B) names as the source. Section 3.3(b) also lets you take a copy from the contracting or sponsoring agency, so check any agency copy against the list above.
  2. Find your agency's notice in the contract documents, and ask in writing if there is none. Compare any payroll software or template with the current form; the WH-347 guide lists the fields.
  3. Have the contractor, or its agent who pays or supervises payment, sign page 2. See the signature question below. On HUD-funded work, read who signs the HUD Statement of Compliance.

What ALDOT's manual adds

ALDOT's Construction Manual 109 (updated 7/2025, before the 2026 notice) says forms AL-150 and AL-100 verify and certify compliance with federal labor laws. Both forms and the certified payrolls are prepared and submitted weekly by the prime contractor for each contract when subcontractors are performing work. AL-150 is not required to be submitted when the prime contractor performs all the work. The manual does not say what AL-100 or AL-150 contain, so ask your ALDOT project manager.

Questions

Is the new WH-347 mandatory?
The form is optional under 29 CFR 5.5(a)(3)(ii)(B), and ALDOT's notice says the same. The notice also says that from October 1, 2026 all prime contractors and subcontractors are required to submit certified payroll reports using the revised WH-347, and that any alternative format must fully capture every reporting element of it.
Can I still use the old WH-347 marked Rev. December 2008?
Not on an ALDOT contract from October 1, 2026, per its notice. An IEDA CDBG training slide says the new form must be used starting 1/1/2026. Ask any other agency in writing.
What OMB number and expiry should the current form show?
DOL's WH-347 instructions page shows OMB Control No. 1235-0008, expires 01/31/2028. The West Virginia DOT copy of the form shows the same, plus Rev. January 2025.
My agency's website still has the 2008 form. Which one do I use?
A hosted copy is not an instruction. Check the notice or contract for the cutover date, and ask in writing if there is none.
Can I use my payroll software's own format?
The regulation allows any format that carries the required information and the signed Statement of Compliance. ALDOT wants every element of the revised WH-347, and FDOT wants all the information USDOL requires. Confirm with your agency.
Is a scanned signature on the Statement of Compliance acceptable?
DOL's WH-347 instructions page says photocopies or scanned copies of signatures do not satisfy the requirement and that legally valid electronic signatures are acceptable. The federal text is 29 CFR 5.5(a)(3)(ii)(E): the signature must be an original handwritten signature or a legally valid electronic signature. Two agency sources differ from it. HUD Handbook 1344.1 REV-3 (January 2023) calls for an original ink signature, and Iowa DOT's Construction Manual 2.20 (revised 1/31/20) allows a scanned copy to go to the project engineer if you keep the original. Both are dated before the final rule published August 23, 2023, which includes paragraph (E). The sources do not say which controls on your job, so get your agency's answer in writing.
